This Privacy Policy describes how Red Apple Fireworks (the "Site", "we", "us", or "our") collects, uses, and discloses your personal information when you visit, use our services, or make a purchase from redapplefireworks.com (the "Site") or otherwise communicate with us (collectively, the "Services").

For the purposes of this Privacy Policy, "you" and "your" means you as the user of the Services, whether you are a retail customer, a member of Club Red Apple®, or a B2B/wholesale partner.

1. PERSONAL INFORMATION WE COLLECT

When you visit the Site, we collect certain information about your device, your interaction with the Site, and information necessary to process your purchases. We may also collect additional information if you contact us for customer support, create an account, join Club Red Apple®, sign up for marketing, or apply for/participate in our B2B/Wholesale programs.

Information Collected Directly from You

The personal information that we collect directly from you may include:

  • Contact information: Such as name, billing address, shipping address, email address, and phone number.
  • Order information: Such as products purchased, date of purchase, transaction identifiers, invoices, returns/exchanges, and payment information (processed through secure payment gateways; we generally do not store full payment card numbers).
  • Account information: Such as your username, password, and other account authentication information.
  • Age and eligibility confirmations (where applicable): Information you provide to confirm you meet any age or legal eligibility requirements to purchase regulated products.
  • B2B & Wholesale information: In addition to standard contact information, for B2B participants, we may collect:
    • business entity name, business addresses, and business phone number;
    • business contact information (including name, title/role, email, and phone number for authorized contacts);
    • federal tax IDs (EIN) and other tax-related documentation;
    • state resale certificates and exemption documentation;
    • copies of local or state fireworks permits or licenses and related compliance documentation as required by our Compliance & Licensing Certification standards;
    • account preferences and authorizations (e.g., authorized purchasers, shipping destinations, and pickup personnel).
  • Customer support information: Information you choose to include in communications with us, including misfire reports or defect claims.
  • User-generated content and communications: Content you submit to us (for example, product reviews, survey responses, or messages), and records of communications (including call recordings where permitted by law and with any required notice).

As you navigate the Site, we automatically collect certain information about your device and usage of the Services, including:

  • Fulfillment and operations: Processing payments, calculating taxes, arranging for shipping or pickup (including freight and palletized shipments for B2B orders), providing invoices and/or order confirmations, handling returns/exchanges, and delivering customer service.
  • Account creation and management: Creating and managing your retail, Club Red Apple®, and/or B2B/Wholesale accounts, authenticating you, and maintaining your preferences.
  • Communication: Communicating with you regarding orders, product updates, safety notices, administrative messages, and (where you opt in or where permitted by law) promotional offers.
  • Risk assessment and security: Screening orders for potential risk or fraud, helping to protect the Services, our customers, and our business from malicious, deceptive, fraudulent, or illegal activity, and enforcing our terms and policies.
  • B2B/Wholesale program administration: Verifying compliance with licensing and permit requirements; reviewing resale certificate documentation; setting up and maintaining your wholesale account; administering authorized purchaser lists, shipping locations, and payment terms (if applicable); managing Minimum Advertised Price (MAP) policy adherence; administering authorized digital asset releases; and communicating about wholesale pricing, inventory, and order logistics.
  • Purchasing history and relationship management (including B2B): Using your purchasing and account history to (a) provide you with consistent pricing/account support, (b) recommend products, (c) forecast demand and manage inventory, (d) handle warranty, misfire/defect claims, recalls, and safety issues, and (e) support our internal reporting and auditing.
  • Marketing and personalization: Providing you with information or advertising relating to our premium fireworks and Club Red Apple® perks, in line with the preferences you have shared with us. We may tailor marketing based on your interactions with the Services and whether you are a retail consumer or a wholesale buyer.
  • Legal compliance: Complying with applicable laws and regulations related to regulated products, tax, accounting, and recordkeeping, and responding to lawful requests.

3. SHARING YOUR PERSONAL INFORMATION

We share your Personal Information with third parties to help us use your Personal Information, as described above, and to operate our business.

We also use service providers for functions such as payment processing, fraud prevention, analytics, email/SMS delivery, customer support tools, marketing services, hosting, and IT/security.
  • Logistics Partners: We share your information with shipping and freight carriers and logistics providers to ensure the delivery of your fireworks (including delivery appointment coordination and proof of delivery).
  • B2B/Wholesale account administration: For B2B/Wholesale accounts, we may share relevant business contact details, shipping destinations, and order history on a need-to-know basis with service providers who support wholesale operations (for example, accounting, fulfillment, freight, customer support, and compliance vendors).
  • Business transfers: If we are involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of all or a portion of our business or assets, information may be disclosed or transferred as part of that transaction, subject to standard confidentiality protections.
  • Legal compliance and protection: We may share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant, court order, or other lawful request for information, or to otherwise protect our rights, safety, and property and the rights, safety, and property of our customers and others.
  • Regulatory authorities: For B2B transactions (and other regulated sales, as applicable), we may share licensing and permit verification data with state or local fire marshals or regulatory agencies if required by law to verify the legality of a fireworks transfer.

We do not sell personal information in the conventional sense. We may share information with advertising and analytics partners as described in Section 4 (Behavioral Advertising), which may be considered “sharing” under certain state privacy laws.

4. BEHAVIORAL ADVERTISING

As described above, we use your Personal Information to provide you with targeted advertisements or marketing communications we believe may be of interest to you. This includes customization of offers based on whether you are a retail consumer or a wholesale buyer.

We may use third-party advertising and analytics partners to help us deliver ads, measure performance, and understand how people interact with the Services. When you place an order through the Site, we will maintain your Order Information for our records unless and until you ask us to delete this information (subject to legal and operational requirements). For B2B/Wholesale customers, we may retain wholesale account records (including business contact information, purchasing history, invoices, resale certificates, and licensing/certification documentation) for the duration required by applicable federal and state record-keeping laws and for legitimate business needs (such as tax, accounting, compliance audits, and safety/regulatory traceability).

Where feasible, we may de-identify or aggregate information so it is no longer reasonably associated with you or your business.

6. YOUR RIGHTS

Depending on where you live, you may have the right to access the personal information we hold about you and to ask that your personal information be corrected, updated, or deleted. You may also have the right to receive a copy of your information, to opt out of certain processing (such as targeted advertising), and to limit or object to certain uses.

B2B/Wholesale account notes: Business contact information (such as name, business email, business phone number, title/role) and purchasing history are used to administer and support the wholesale relationship. Requests to delete or restrict this information may limit our ability to provide wholesale pricing, process orders, provide customer support, maintain tax and compliance records, or meet legal and regulatory obligations.

Please note that we may be unable to delete certain information if it is required for legal compliance, particularly concerning the sale and distribution of regulated fireworks, the maintenance of tax-exempt wholesale records, accounting requirements, fraud prevention, or regulatory traceability.

7. CHANGES

We may update this privacy policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal, or regulatory reasons.
