SHIPPING POLICY

Welcome to Red Apple Fireworks®! We are dedicated to delivering the most epic fireworks in the U.S. straight to your door or to a convenient Fireworks Pickup Spot™. Because our products are classified as DOT 1.4G Hazardous Materials, shipping them requires specialized handling and compliance with federal and state regulations.

By placing an order with Red Apple Fireworks®, you agree to the following shipping terms and conditions.

1. GENERAL SHIPPING PROVISIONS

All fireworks sold by Red Apple Fireworks® are shipped in accordance with U.S. Department of Transportation (DOT) regulations for UN0336, Fireworks, 1.4G. Due to the nature of these products, they cannot be shipped via USPS, FedEx Ground, or UPS Ground. We utilize specialized freight carriers to ensure safe and legal transport.

2. DELIVERY METHODS (DELIVERY OR FIREWORKS PICKUP SPOT™)

• Residential & Commercial Delivery: We offer delivery to residential and commercial addresses where permitted by law and by available carrier service for DOT 1.4G Hazardous Materials.
• Fireworks Pickup Spot™ (Pickup Procedures): Customers may elect to have orders shipped to a designated Fireworks Pickup Spot™ for local collection, where available. Pickup procedures, location availability, pickup windows, and identification requirements may vary by spot and carrier scheduling. Customers are responsible for: (i) monitoring tracking and pickup notifications, (ii) arriving during posted pickup windows with any required identification and order confirmation, and (iii) loading/transporting product safely and legally after pickup. If an order is not picked up within the pickup window (or within any carrier/spot hold period), the shipment may be returned, rerouted, or assessed additional storage, redelivery, or return freight charges.
• Staging & Fulfillment: Orders are typically processed and shipped from our fulfillment centers in Nevada, Michigan, or Georgia. Fulfillment location may change based on inventory, compliance, routing, or carrier constraints.

3. SHIPPING COSTS & FEES (FREIGHT, PALLETS, AND ACCESSORIALS)

Shipping costs are calculated at checkout (or in a B2B quote) based on shipment weight and dimensions, hazardous materials handling requirements, distance, and prevailing carrier pricing and accessorials.

• Freight Charges (Estimates; Final Charges): Any shipping charge shown at checkout, in a cart, in a quote, or on an invoice may be an estimate based on then-current carrier rates and known shipment details. If actual carrier charges, accessorials, or handling requirements differ from the estimate (including due to address corrections, reclassification, appointment requirements, limited access, or other carrier-determined adjustments), Red Apple Fireworks® may adjust shipping charges accordingly to reflect the actual cost of shipment to the extent permitted by law.
• Pallet & Packaging Costs: Orders may be palletized, crated, banded, and/or otherwise packaged to protect product integrity and comply with hazardous materials and carrier requirements. A palletization and/or packaging fee may be applied per order (and may include pallet cost, packing materials, and labor). Where applicable, pallet and packaging charges are in addition to freight charges.
• Accessorials & Surcharges: Additional fees may apply, including (without limitation) residential delivery, liftgate service, inside delivery, appointment delivery, limited access delivery, redelivery, detention/storage, address correction, and other carrier or terminal fees incurred due to delivery conditions or customer unavailability.

4. SHIPPING MODIFICATIONS; TARIFFS; CARRIER ADJUSTMENTS; “NO OFFER TO SELL” AND REGIONAL RESTRICTIONS

For our B2B and wholesale partners, the following supplemental shipping terms apply:

• Shipping & Pricing Adjustments (Freight, Carrier Changes, Tariffs): Red Apple Fireworks® reserves the right to modify shipping methods, routes, carriers, and shipping-related charges, and to correct any errors in shipping quotes or invoices, at any time. This includes (but is not limited to) changes necessitated by fluctuations in ocean freight, domestic trucking, fuel, hazardous materials handling fees, terminal charges, and/or government actions such as new or increased tariffs, duties, taxes, or regulatory fees, as well as carrier-imposed adjustments, re-weigh/re-class charges, or accessorial charges.
• No Offer to Sell (Shipping/Regional Restrictions): Any product listing, inventory indication, delivery estimate, shipping rate, or freight quote (whether on our website, in a wholesale price list, or in any communication) is provided for informational purposes only and does not constitute an offer to sell, ship, or deliver to any particular person or location. Acceptance of any order and the ability to ship are expressly conditioned on: (i) legal permissibility in the destination jurisdiction and along the shipping route (as applicable), (ii) carrier availability and acceptance of the shipment, and (iii) Red Apple Fireworks®’ internal compliance and risk review. We may reject, cancel, hold, or modify any order or shipment in our sole discretion where shipping is restricted, impracticable, or noncompliant.

5. TRANSFER OF RISK & TITLE

For all shipments, the risk of loss and title passes to the buyer at the "FOB Shipping Point." This means Red Apple Fireworks®' responsibility ends, and the buyer’s responsibility begins, once the carrier takes possession of the shipment at our warehouse.

6. INSPECTION & DELIVERY DISCREPANCIES

It is the buyer's responsibility to inspect all shipments immediately upon arrival.

• Damage/Shortage: Any visible damage to the packaging or shortage in the piece count must be noted clearly on the Bill of Lading (BOL) before signing for the delivery.
• Reporting: You must report any shipping discrepancies or damage to the Red Apple Fireworks® Customer Experience team within 24 hours of delivery. Failure to note damages on the BOL or report them promptly may waive your right to a claim with the carrier.

7. SHIPPING RESTRICTIONS

• Prohibited Jurisdictions: We do not ship to states, counties, or cities where fireworks are prohibited by law. It is the buyer’s sole responsibility to ensure that the products ordered are legal in their destination jurisdiction.
• P.O. Boxes: We cannot ship to P.O. Boxes or APO/FPO addresses.
• Signature Required: An adult (21+) must be present to sign for all deliveries of hazardous materials.

8. FORCE MAJEURE

Red Apple Fireworks® is not liable for shipping delays caused by circumstances beyond our control, including but not limited to: weather conditions, carrier equipment failures, labor strikes, government-imposed burn bans, or other acts of God. Please refer to our Burn Ban & Force Majeure Policy for more details regarding returns and cancellations.
